Lee Reacts to Oral Argument in Recess Appointments Case
Jan 13, 2014
Today, Senator Mike Lee said that he expects the Supreme Court to determine that President Obama’s controversial recess appointments from January 2012 were unconstitutional. Sen. Lee, who is a former Supreme Court clerk for Justice Samuel Alito, has been a strong and vocal opponent of President Obama’s attempt to usurp the rights of the Senate in the appointment and confirmation of nominees to the executive and judicial branch. He attended the oral argument today in the case of National Labor Relations Board v Noel Canning.
Lee Reacts to Supreme Court Decision to Hear Recess Appointment Case
Jun 24, 2013
Although I am pleased to hear that the Supreme Court will address the constitutionality of President Obama’s purported recess appointments, had the Senate protected its institutional prerogatives and objected to the President’s violation of the Constitution’s separation of powers, the case would never have needed to go to court.
Lee Praises D.C. Circuit Ruling on President Obama’s Unconstitutional “Recess” Appointments
Jan 25, 2013
Over the course of the last year, I have spoken out against these unprecedented and unconstitutional actions in numerous settings, including in meetings of the Senate Judiciary Committee, on the floor of the U.S. Senate, in a hearing before the House Committee on Oversight and Government Reform, and in countless interviews in the press. In protest of these unconstitutional appointments, I voted against President Obama’s judicial and executive appointments. Today’s decision represents vindication of the principled stand I have taken against this President’s disregard of our nation’s Constitution.

Mar 14, 2012

Democratic Hypocrisy
Mar 14, 2012
Claims of Republican obstruction are not only demonstrably false, they are highly hypocritical. The very Democrats now seeking to manufacture confirmation controversy personally devised and carried out a systematic effort to block President Bush’s judicial nominees through an unprecedented use of the Senate filibuster.
Lee Blasts Reid on Nominations ‘Stunt’
Mar 12, 2012
Senator Harry Reid’s action is nothing more than a political stunt designed to distract the American people from the Democrats’ legislative failures. His sudden interest in judicial nominations is a desperate attempt to draw attention away from his party's failure to address our nation's economic emergencies.

LEE: Obama’s lawless recess appointments
Feb 28, 2012
The president cannot expect the Senate’s full cooperation at the same time that he does violence to Congress‘ constitutional prerogatives. In response to the president’s unconstitutional actions, the Senate must adopt a new threshold for confirming his nominees. Simply put, there is a new standard for Senate confirmations.
