On September 9, 2021 President Biden announced that his Administration would “require more Americans to be vaccinated.” Since this announcement, three separate vaccine mandates have been issued. First, a requirement that all employers with 100 or more employees ensure that their entire workforce is either fully vaccinated or shows a negative test at least once a week  by January 4, 2022. Second, a requirement that any employee of a facility that participates in Medicaid or Medicare must be fully vaccinated by January 4, 2022. Lastly, a requirement that all federal employees be fully vaccinated by November 22, 2021 and that all federal contractors and subcontractors be fully vaccinated by January 18, 2022.

Senator Lee is personally vaccinated, encourages others to consider vaccination against COVID-19 with the consultation of their doctor, and views the rapid development of the COVID-19 vaccines as a miracle that safeguards the vulnerable from severe illness and hospitalization.  However, these requirements as President Biden stated, “are not about freedom or personal choice.” Therefore, in response to these Constitutionally dubious and autocratic mandates, Senator Lee has introduced multiple pieces of legislation and promised to speak on the Senate floor to highlight the flaws and consequences of these mandates. Below you will find more information on each of those efforts.

DAY 19:

The Only Thing I Want to Shut Down is the Unconstitutional Vaccine Mandate

For the nineteenth day, I spoke against President Biden’s vaccine mandate on the Senate Floor.  I spoke about my letter with fourteen other Senators stating our intention to oppose any funding measure that supports the mandate.  I explained that due to denial and delay of Majority Leader Chuck Schumer, I am requesting a simple majority vote on one amendment to grant my consent to pass the funding measure in a short time period.

I said, “Senator Schumer is in a bind due to his own delay and denial, he is asking all of us to help him.  I have offered a simple solution.  I am not asking that a poison pill or a pet project be included.  I am not asking for dramatic reforms or draconian cuts.  I just want a vote on one amendment.  I want the members of this body to go on the record on funding President Biden’s vaccine mandate.”

I continued, “If Senator Schumer wants to avoid this vote so badly that he will shut down the government rather than hold it, he should explain why.  We can fix this situation right now.  Let’s hold a vote.”

DAY 18:

Sen. Lee Continues Fight Against Biden’s Vaccine Mandate 

“… To Respect our Military …”

For the eighteenth day, I spoke against President Biden’s vaccine mandate on the Senate Floor and asked the Senate to pass by unanimous consent my bill to protect members of the military from President Biden’s military vaccine mandate.  

I again offered my bill, S. 2842, the Respecting Our Servicemembers Act, which has previously been rejected by Senate Democrats. 

DAY 17:

“… To Protect Our Federal Workforce …”

 

For the seventeenth day, I spoke against President Biden’s vaccine mandate on the Senate Floor and asked the Senate to pass by unanimous consent my bill to protect the federal workforce from President Biden’s federal workforce vaccine mandate.

I offered my bill, the “Protecting Our Federal Workforce From Forced COVID-19 Vaccination Act,” which would protect federal workers from the President’s vaccine mandate.

DAY 16:

Sen. Lee Continues Fight Against Biden’s Vaccine Mandate 

“… To Protect Frontline Workers …”

 

For the sixteenth day, I spoke against President Biden’s vaccine mandate on the Senate Floor and asked the Senate to pass by unanimous consent my bill to protect frontline workers from losing their jobs due to President Biden’s Center for Medicare and Medicate Services (CMS) vaccine mandate.

I said, “Doctors, nurses, and healthcare workers can either get a medical procedure they do not want or lose their current employment and any future prospect of employment. These heroes will be thanked for their service with a pink slip and a boot out the door as they become outcasts in the profession they have chosen, spent hard money training for, and dedicated their lives to.  What a tragedy.”  

I offered my bill the “Respecting Our Frontline Workers Act” which would protect medical workers from the CMS vaccination mandate.

DAY 15:

The Twelve Bills Democrats Rejected

“… Twelve Bills …”

For the fifteenth day, I spoke against President Biden’s vaccine mandate on the Senate Floor and reviewed the dozen bills I have offered that have each been rejected by Democrats. 

I also shared my thoughts regarding the Fifth Circuit Court of Appeals’ decision to halt President Biden’s vaccine mandate.

“Thankfully, while some in this body have floundered, judges on the Fifth Circuit fulfilled their duty to the American people and the Constitution.  That does not mean, however, that this fight is anywhere near over.  I will continue this fight here.  I will stand for those Utahns and Americans who are at risk because of this mandate.  So, yes, Mr. President, I will be back tomorrow, and as long as it takes.  I will not stop until we win this fight.”  

I will return to continue my effort against the mandate in coming days.

DAY 14:

Sen. Lee Continues Push Against Biden’s Vaccine Mandate 

“… To End the Mandate …”

For the fourteenth day, I spoke against President Biden’s vaccine mandate on the Senate Floor and asked the Senate to pass by unanimous consent my bill to clarify that federal law does not authorize the President to issue a general vaccine mandate.

 

I also shared my thoughts about the leaked mandate draft that will be published in the Federal Register tomorrow. 

It is true that President Biden’s vaccine mandate is yet to be officially published in the federal register. However, it will be tomorrow. The unpublished mandate can be found, and here is some of what it entails. If an employer has an employee that has yet to be vaccinated, President Biden is requiring the employer to pay workers for the time it takes to get vaccinated and provide sick leave for workers to recover from any side effects. And what happens if a business does not comply? President Biden has threatened a nearly $14,000 fine per violation, per person, per day. This is an administrative nightmare. If employees don’t want to be vaccinated against COVID-19 then they must pay for the testing. American workers will be on the hook and it’s something most Americans simply cannot afford.”  

 

I offered my bill the No Forced Vaccination for COVID-19 Act which would prevent federal vaccine mandates from taking effect without approval from Congress.

DAY 13:

Sen. Lee Continues Push Against Biden’s Vaccine Mandate 

“… To Defund the Mandate …”

For the thirteenth day, I spoke against President Biden’s vaccine mandate on the Senate Floor today and promoted my letter with Senator Roger Marshall (R-KS) in which the Senators commit to oppose any measure that would provide funding for the vaccine mandate.

I have now introduced twelve bills and written a letter to Senate Majority Leader Chuck Schumer (D-NY) to counteract the mandate.  I will continue my efforts against the mandate in coming weeks.

For the twelfth day, I spoke against President Biden’s vaccine mandate on the Senate Floor and promoted my bill to require that the Director of the CDC be confirmed by the Senate before taking office.

I introduced 12 bills counteracting Pres. Biden’s vaccine mandate and am asking one-by-one that the Senate adopt the measures to protect millions of Americans at risk of unemployment due to the mandate. 

 S. 2850, the Biden Can’t Force Me Act, which would require exemptions from the mandate for Americans with sincerely held beliefs.
